This Tax Reporting and 1099-K Policy governs tax-related obligations for users of List99 (the “Platform”). This Policy is incorporated into and governed by the List99 Terms of Service.
1. General Tax Responsibility
Users are solely responsible for determining, reporting, and paying all taxes arising from transactions or income associated with the Platform. List99 does not provide tax, accounting, or legal advice.
2. Tax Information Collection
To comply with IRS, anti-money laundering, payment, and other legal requirements, List99 may require users to provide legal name, address, date of birth, tax identification number, business information, certification forms, or other tax-related documentation.
3. Verification and Restrictions
Failure to provide valid tax information may result in payment holds, payout blocks, backup withholding, account restrictions, or inability to process transactions or receive funds.
4. Form 1099-K Reporting
List99 may issue IRS Form 1099-K and other tax forms as required by applicable federal, state, or local law.
5. Current Federal Threshold
Under the reporting thresholds reflected in the reference materials used for this policy, Form 1099-K reporting may apply when a user exceeds both:
- $20,000 in gross payment volume, and
- More than 200 transactions in a calendar year
List99 may also report where backup withholding applies, where state law imposes lower thresholds, or where other legal requirements apply.
6. State-Level Reporting
Some states may require reporting at thresholds lower than the federal threshold. Users may receive tax forms even if they do not meet the federal threshold.
7. Multi-Account Aggregation
If multiple accounts are associated with the same tax identification number or legal entity, List99 may aggregate transaction volume or gross payment volume across accounts for reporting, verification, withholding, or compliance purposes.
8. Gross Payment Reporting Clarification
Amounts reported on Form 1099-K or similar forms may reflect unadjusted gross payment volume. This may differ from a user’s net earnings because it may not account for fees, credits, refunds, chargebacks, discounts, or other adjustments unless applicable law requires otherwise.
9. Backup Withholding
List99 may apply backup withholding where required by law, including where a user fails to provide valid tax information, where tax records do not match, or where tax authorities direct withholding. Amounts withheld are generally remitted to taxing authorities, not refunded by List99.
10. International Users
Non-U.S. users may be required to provide documentation such as Form W-8 or other certifications. Failure to provide required information may result in withholding, payout restrictions, or inability to use certain Platform features.
11. Delivery of Tax Documents
Where required, tax forms may be delivered electronically, by mail, or both. Users are responsible for maintaining accurate account, address, and tax information.
12. Corrections and Inquiries
Users should promptly notify List99 of possible errors in tax information or tax forms and provide supporting documentation as requested. List99 may require verification before issuing corrections.
13. Third-Party Payment Processors
Where third-party processors are involved, users may receive separate forms or notices from those providers. List99 is not responsible for forms issued by independent processors.
14. Security of Tax Information
List99 uses reasonable measures to protect tax information but cannot guarantee absolute security. Users should not share sensitive tax information through insecure channels unless explicitly instructed through secure methods.
15. Platform Rights
List99 may request tax information at any time, verify tax data, report transaction data to tax authorities, restrict or close accounts pending compliance, and retain records as required by law.
16. No Tax Advice
Users should consult a qualified tax professional for advice regarding tax returns, deductions, gross-versus-net reconciliation, withholding, state requirements, or any tax consequence of using the Platform.
17. Modifications
List99 may modify this Policy at any time. Continued use constitutes acceptance of any revised terms.
