This Intellectual Property Policy governs copyrighted material, trademarks, patents, publicity rights, designs, trade dress, and other proprietary rights on List99 (the “Platform”). This Policy is incorporated into and governed by the List99 Terms of Service.
1. Ownership of Platform Content
All Platform text, graphics, logos, icons, images, software, videos, compilations, and related materials, excluding authorized user content, are owned by List99 or its licensors and protected by intellectual property laws.
2. Trademarks
List99 names, logos, service marks, trade dress, and branding elements are the property of List99. They may not be used without prior written permission in any manner likely to cause confusion, imply affiliation, or harm List99’s reputation.
3. Patents and Proprietary Technology
Certain Platform features or services may be protected by patents or proprietary rights. You may not copy, replicate, reverse engineer, or exploit Platform functionality in violation of applicable rights.
4. User Content Responsibility
Users are solely responsible for ensuring that listings, photos, videos, text, logos, brand references, designs, product packaging, and all other submitted content do not infringe the rights of others.
5. Prohibited Infringing Activity
- Counterfeit or replica goods
- Unauthorized copies of software, music, video, books, art, photography, or digital content
- Unauthorized use of images, descriptions, logos, brand names, trade dress, or design elements
- Listings that infringe patents, designs, utility models, publicity rights, or other protected rights
6. Listing and Content Requirements
Users should create original listing content or use content with proper authorization. Brand names may be used only to accurately identify authentic or lawfully compatible products and may not be used deceptively to attract search traffic or imply endorsement.
7. Reporting Infringement
If you believe content or a listing infringes your rights, you may submit a notice including:
- Your physical or electronic signature
- Identification of the copyrighted work, trademark, patent, or other right asserted
- The URL or location of the allegedly infringing material
- Your contact information
- A good-faith statement that the use is unauthorized
- A statement under penalty of perjury that the information is accurate and that you are the rights holder or authorized representative
8. Counter-Notice
If your content was removed and you believe the removal was mistaken, you may submit a counter-notice containing legally required information where applicable.
9. Repeat Infringers
List99 may remove content, restrict listings, suspend accounts, withhold funds, or terminate repeat infringers.
10. Platform Enforcement
List99 may remove or disable access to allegedly infringing content, request documentation, preserve evidence, report conduct, or take other enforcement actions in its sole discretion.
11. No Liability for User Content
List99 is not liable for user-generated content or for content removal decisions made in response to notices, suspected infringement, or policy enforcement.
12. Third-Party Rights
Users must respect all third-party rights. List99 does not guarantee that any user has valid rights in any content or item listed on the Platform.
13. Contact for Notices
Notices should be sent to the intellectual property or legal contact designated by List99 on the Platform.
14. Modifications
List99 may modify this Policy at any time. Continued use constitutes acceptance of any changes.
