By using any part of the List99 Platform — including but not limited to buying, selling, listing, bidding, promoting a Listing, generating or using a Referral Link, attending or participating in a Community Market or event, or interacting with any other User — you agree to RELEASE, WAIVE, AND HOLD HARMLESS List99 Inc., its officers, directors, employees, agents, contractors, and affiliates (collectively, "List99") from any and all claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees), of any kind, whether known or unknown, arising out of or in any way connected to:

  • Any transaction between you and another User, including disputes over price, condition, description accuracy, payment, delivery, or performance;
  • Any personal injury, property damage, financial loss, or death arising from your use of the Platform, participation in a Community Market or event, or interaction with any other User, vendor, or Organizer;
  • The acts, omissions, statements, or conduct of any other User, Seller, Buyer, vendor, or Organizer;
  • Any inaccuracy, error, or omission in a Listing, in AI-generated or AI-assisted content, or in third-party data (including vehicle data sourced from NHTSA) displayed on the Platform;
  • Any interruption, delay, error, security incident, or unavailability of the Platform or any third-party service the Platform relies on (including payment processors, shipping carriers, and AI service providers);
  • Your consumption of any food or perishable item purchased through the Platform;
  • Any tax, fee, or reporting obligation arising from your use of the Platform, including your own tax reporting responsibilities;
  • Any other matter arising from or related to your access to or use of the Platform, to the maximum extent permitted by applicable law.

This release does not apply to List99's own gross negligence or willful misconduct, to the extent such a limitation is required by law. This Hold Harmless & Release provision is in addition to, and does not replace, the Limitation of Liability and Indemnification provisions in the main Terms & Conditions (Sections 18 and 19).
